  • South African maintenance courts consider the reasonable needs of the child and the financial means and circumstances of both parents. They do not use a fixed formula; this proportional split is a common starting point for discussion, not a legally enforceable amount.
  • Both parents have a duty to support their children. Maintenance can be claimed at no cost at your local magistrate’s court (maintenance court).
  • Your figures are not included in share links.

How the estimate works

Parent’s share = total monthly costs × parent’s net income ÷ combined net income

The calculator adds up the children’s monthly costs, divides them in proportion to each parent’s net income and shows the share of the parent the children do not live with. If you enter what is currently paid, it shows the difference.

Important

This is an educational estimate, not a determination of a legally enforceable amount. Courts look at the full picture — including other dependants, special needs, each household’s costs and contact arrangements. Your figures are kept out of shareable links.

Worked example

Parents earning R25 000 and R35 000, child lives with parent 1

Parent 2 earns 58% of the combined income, so their estimated share of the R8 800 monthly costs is about R5 133. Parent 1 contributes their share mainly by providing the home and daily care.

Frequently asked questions

How is child maintenance calculated in South Africa?

There is no fixed formula. Under the Maintenance Act, courts consider the child’s reasonable needs and both parents’ means and circumstances. A proportional split of the child’s costs according to income is a common starting point.

Do both parents have to pay maintenance?

Yes. Both parents have a duty to support their child according to their means, whether or not they were married. The parent the child lives with contributes through day-to-day care and costs.

How do I claim maintenance?

Apply at the maintenance court at your nearest magistrate’s court. It is free, and you do not need a lawyer. The court can also order the other parent to disclose their income.

What costs can be included?

Reasonable costs for the child, such as a share of housing, food, school fees, transport, medical costs, clothing and childcare. Keep receipts and a budget — courts look for evidence.
